1. Acceptance of Terms
By creating an account or using the Decibell mobile application or website (the "Service"), you agree to be bound by these Terms of Use. If you do not agree, do not use the Service. The Service is operated by ODBS Tech ("Decibell", "we", "our", or "us").
2. Description of Service
Decibell is a communications application that lets you purchase virtual phone numbers from supported countries and use them to send and receive SMS messages, MMS, and voice calls. Decibell is not itself a telecom carrier — communications are delivered through licensed third-party telecom providers.
3. Eligibility & Account
You must be at least 13 years old (or the minimum age in your country) to use the Service. You are responsible for safeguarding your account credentials and for all activity under your account. You agree to provide accurate information and to keep it up to date.
4. Acceptable Use
You agree not to use the Service to:
- Send unsolicited bulk SMS, spam, marketing without consent, or other abusive messaging in violation of applicable law (including TCPA, CAN-SPAM, GDPR, A2P 10DLC, and similar telecom regulations).
- Engage in fraud, phishing, impersonation, harassment, or threats.
- Distribute illegal content (including child sexual abuse material, content that infringes intellectual property, or content that violates export-control or sanctions law).
- Attempt to use the Service for emergency calling (911, 112, 999, 110, 000, etc.). Virtual numbers cannot reach emergency services.
- Reverse engineer, scrape, or interfere with the Service, attempt to bypass rate limits, or access another user's account.
- Use the Service in ways that violate the acceptable-use policies or terms of our underlying telecom providers.
- Send messages containing SHAFT-restricted content (Sex, Hate, Alcohol, Firearms, Tobacco, Vape/E-cigarettes, Cannabis, or CBD) regardless of legality in your jurisdiction, as such content is prohibited by our underlying telecom carriers' acceptable-use policies.
- Circumvent or ignore carrier-level opt-out requests (STOP, UNSUBSCRIBE, END, QUIT, OPTOUT, REVOKE, CANCEL, STOPALL). You agree not to attempt to message a recipient who has opted out from your number, or to evade opt-out enforcement by switching numbers or using multiple accounts.
5. No Emergency Services
Decibell virtual numbers do not support emergency calling. They cannot be used to dial 911, 112, 999, or any other emergency number. Always have a regular mobile or landline phone available for emergencies. We are not liable for any inability to reach emergency services through the Service.
6. Number Provisioning, Cancellation & Reclamation
When you purchase a virtual phone number, the underlying telecom provider assigns the number to your account for the duration of your active subscription. If your subscription lapses or you release the number, the number returns to the provider's pool and may be reassigned to another user — we cannot guarantee that you will ever recover it. Some countries impose registration or identity-verification requirements; if those apply, we will request the necessary information before activating the number.
7. Subscriptions & Billing
Phone numbers and premium features are sold as in-app purchases through Apple's App Store. Subscriptions auto-renew unless canceled at least 24 hours before the end of the current period, in line with App Store policies. Subscription validation and entitlement tracking are handled by RevenueCat. To manage or cancel a subscription, use your App Store account settings. Refunds are governed by Apple's refund policy and applicable law.
8. Third-Party Telecom Providers
When you send SMS or place a voice call, your communication is routed through one of our licensed telecom partners — currently Twilio, Telnyx, and Vonage. Decibell operates as an independent software vendor (ISV) and multi-tenant platform: all phone numbers you purchase through the Service are provisioned under Decibell's accounts with these carriers, and your traffic is subject to each carrier's acceptable-use policy in addition to these Terms. Decibell selects the provider for each message or call based on country, availability, and quality. Where required for routing to U.S. or Canadian destinations, your messages are sent through Decibell's verified messaging service (10DLC campaign or Toll-Free Verification) registered under Decibell's brand with The Campaign Registry (TCR).
9. Service Availability
The Service is provided on an "as is" and "as available" basis. Coverage in any country depends on the availability of underlying telecom providers and may change. We do not guarantee uninterrupted operation, error-free delivery of every message or call, or compatibility with every third-party service that uses your number for verification.
10. Privacy
Our handling of your data is governed by our Privacy Policy, which forms part of these Terms.
11. Termination
You may terminate your account at any time by deleting it from inside the app or via the Account Deletion page. We may suspend or terminate your account if you violate these Terms or any applicable law, or if your continued use of the Service places Decibell or a telecom partner at risk.
12. Limitation of Liability
To the maximum extent permitted by law, Decibell and its affiliates are not liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill arising from your use of the Service. Our total liability for any claim related to the Service is limited to the amount you paid us in the twelve months preceding the claim.
13. Changes to These Terms
We may update these Terms from time to time. Material changes will be communicated through the app or via email. The "Last updated" date at the top reflects the most recent revision. Continued use of the Service after a change becomes effective constitutes acceptance.
14. Governing Law
These Terms are governed by the laws of Türkiye, without regard to its conflict-of-law principles. Any dispute will be brought before the competent courts of Istanbul, unless mandatory consumer protection law in your country gives you a different forum.
